A LEGAL stoush over a Mernda development worth almost $4 million is heading for court.
A real estate agent is claiming more than $500,000 in commission from a developer it claims is refusing to pay, according to documents lodged with the County Court. The documents show the Planinsek Property Group claims it is owed $42,500 commission on each of 12 lots of land on Plenty Road, Mernda it allegedly sold for $325,000 between August, 2010 and March, 2011.
A writ claims an agent for Mernda Mews Developments authorised Planinsek to sell the lots through an exclusive sales authority and that agreement had allegedly been
breached.
It said Planinsek’s lawyers had sent a letter of demand for the commission in February, but a Mernda Mews
representative said he had no
knowledge of the alleged agreement.
In defence documents, Mernda denied any wrongdoing and said it had not authorised its agent to make a sales agreement with Planinsek. Planinsek is also suing Mernda’s agent, who also denies any wrongdoing and denies authorising the alleged sales agreement.
A trial is set for August.
