Charges after forklift hits worker at cured meats warehouse in Mickleham

D’Orsogna faces four charges under section 21(1) of the Occupational Health and Safety Act for failing to provide and maintain a safe workplace.

WorkSafe alleges the company twice breached the act by failing to provide and maintain a safe system of work to separate powered mobile plant and pedestrians, and by failing to properly maintain the forklift.

It is also alleged the company breached the act by failing to provide necessary instruction and training to enable employees to operate a forklift safely.

WorkSafe further alleges D’Orsogna contravened the OHS regulations by failing to, so far as was reasonably practicable, reduce the risk of forklifts colliding with pedestrians or other powered mobile plant.

The matter is listed for a committal mention at the Melbourne Magistrates’ Court on March 25.
